Terms & Conditions

§ 1 Scope

These General Terms and Conditions (T&Cs) apply to all contracts for live musical performances and related services between the artist JÆCK (hereinafter "Artist") and the respective client (hereinafter "Organiser"). Deviating conditions of the Organiser will not be recognised unless the Artist expressly agrees to them in writing.

§ 2 Formation of Contract

A binding contract (performance agreement) is formed upon written confirmation (e-mail is sufficient) of an offer prepared by the Artist by the Organiser. Options and date reservations are non-binding until confirmed in writing as a fixed booking.

§ 3 Fee, Payment Terms & Expenses

  1. The agreed fee is exclusive of any applicable taxes (e.g. VAT, where the small-business exemption does not apply).
  2. Unless otherwise agreed, a deposit of 30 % of the total fee is due within 14 days of contract formation. This deposit secures the date as a fixed booking for the Organiser.
  3. The remaining balance is to be transferred to the Artist's account without deductions no later than 7 days after the performance.
  4. Travel costs, accommodation costs (if the venue is more than 100 km from the Artist's place of residence) and other expenses are listed separately in the offer and are borne by the Organiser.

§ 4 Cancellation Policy

If the Organiser cancels a confirmed booking, the following cancellation fees apply:

  • Up to 90 days before the performance: forfeiture of the deposit (30 % of the fee).
  • 89 to 30 days before the performance: 50 % of the agreed total fee.
  • 29 to 14 days before the performance: 75 % of the agreed total fee.
  • Less than 14 days before the performance: 100 % of the agreed total fee.

Exceptions apply in cases of genuine force majeure (see § 7).

§ 5 Organiser Requirements (Stage & Technical)

  1. The Organiser shall provide an adequate, clean, and safe performance area.
  2. For outdoor events, the stage/performance area must be covered and protected from the elements (rain, direct intense sunlight) to safeguard the Artist's equipment.
  3. A secured power connection (230 V) must be available in the immediate vicinity of the stage.
  4. If the performance cannot take place due to missing technical or safety requirements, the Artist retains the full right to the agreed fee.

§ 6 Catering

The Organiser shall provide the Artist (and any accompanying persons/technicians) with adequate catering (a warm meal) and sufficient non-alcoholic beverages free of charge for the duration of their presence at the venue.

§ 7 Illness & Force Majeure

  1. If the Artist must cancel the performance due to documented illness (medical certificate) or other serious reasons beyond their control, the right to the fee lapses.
  2. Any deposits already paid will in this case be refunded in full to the Organiser.
  3. Any claim by the Organiser for damages is expressly excluded in such cases. The Artist will however endeavour, at the Organiser's request, to arrange a suitable replacement.

§ 8 Copyright & Performing Rights (AKM / GEMA)

The Organiser is solely responsible for registering the event with the relevant performing rights organisation (e.g. AKM in Austria, GEMA in Germany) in good time. All fees arising from the public performance of copyright-protected works are borne by the Organiser. The Artist will provide the Organiser with a setlist in due course.

§ 9 Photo & Audio/Video Recordings

  1. Private photo and audio/video recordings by guests are permitted.
  2. Professional or commercial recordings of the performance by the Organiser or third parties require the prior written consent of the Artist.
  3. The Artist reserves the right to create their own photo and video material at the event for self-promotion, unless the Organiser explicitly objects in advance.

§ 10 Final Provisions

  1. Amendments and additions to the contract must be made in writing.
  2. Austrian law applies.
  3. The place of jurisdiction for all disputes arising from this contract is Vienna.
